Terms of Sale

This is a translation. The French version prevails in case of any difference.
1. Purpose
These terms of sale (the "Terms of Sale") apply to the paid subscription to the Domain Sentinel service (the "Service"). They supplement the terms of service. Subscribing means accepting the Terms of Sale in force on the date of subscription.
2. Subscription reserved for professionals
The paid subscription is reserved for professionals: individuals or legal entities buying it for the needs of their professional activity (company, freelancer, association, public body). By subscribing, you declare that you act in that capacity: accepting these Terms of Sale, which is required at checkout, stands for that declaration. The provisions of the French Consumer Code that apply to contracts with consumers therefore do not apply to this subscription.
A false declaration of professional status may lead to the suspension of the account (terms of service, articles 3 and 5).
3. Publisher and seller
The Service is published and provided by Grégory Boutte, sole proprietor (entrepreneur individuel, SIREN 130 455 447) (the "Publisher").
The sale, invoicing, payment collection and collection of applicable taxes are handled by Stripe, which acts as the merchant of record at checkout ("Sold through Link"). Stripe's terms applicable to the transaction are shown to you at checkout. The Publisher provides the Service and handles requests about how it works and about the refunds provided for in article 8.
4. Plans and prices
The Pro subscription gives access to all the features described on the pricing section, under two plans:

Prices are shown excluding taxes; any taxes applicable in your country and to your status are calculated and shown before payment.
5. Subscription and payment
You subscribe online from your account. Payment is made by card or by the other methods offered at checkout. Pro access opens as soon as the payment is confirmed. An invoice is issued for each payment and sent to you by email.
6. Term, renewal, change of plan and cancellation
The subscription renews automatically at the end of each period (month or year), for the same period.
You can change plan at any time from your account. Moving from the monthly to the yearly plan takes effect immediately: the yearly period is billed at once, less a prorated credit for the unused part of the current monthly period. Moving from the yearly to the monthly plan takes effect at the end of the current yearly period, with no refund.
You can cancel at any time from your account or from your Link account. Cancellation takes effect at the end of the period already paid and gives no right to a refund of the current period, except under article 8. Until that date, Pro access stays open; afterwards, the account returns to the free plan, without any data being deleted.
7. Failed payment
If a payment fails, new attempts are made automatically and you are notified by email. If the payment is not settled, the account returns to the free plan: nothing is deleted, and whatever exceeds the free plan is paused until the account returns to Pro.
In accordance with article L441-10 of the French Commercial Code, any sum not paid when due bears interest by operation of law at the European Central Bank rate plus 10 percentage points, and gives rise to a fixed indemnity of €40 for recovery costs. Claiming them is optional.
8. Money-back guarantee
If the Service does not suit you, you can ask for a refund of your first payment within 14 days of it, at contact@domain-sentinel.com or through the site's contact form. This guarantee applies once per account. The refund is made to the payment method used and ends the subscription.
9. Price changes
Prices may change. A price increase is announced by email to subscribers at least 30 days before it applies; it takes effect at the next renewal after that date, never during a period already paid. You can cancel at no cost before it takes effect. A price decrease may apply immediately. The Publisher may, without being bound to, keep the former price for current subscriptions.
10. Liability and common provisions
The limitation of liability (article 9), the evidence clause (article 11) and the miscellaneous provisions (article 13) of the terms of service apply to the paid subscription.
11. Personal data
The data needed for the subscription and payment is processed as described in the privacy policy. Payment data is processed by Stripe; the Publisher has no access to card numbers.
12. Disputes and governing law
In case of a complaint, first contact the Publisher at contact@domain-sentinel.com to look for an amicable solution.
Any action relating to the subscription must be brought within one year from the day the subscriber knew or should have known the facts on which it is based (article 2254 of the French Civil Code).
The Terms of Sale are governed by French law. The French version prevails in case of any difference with a translation. Failing an amicable agreement, any dispute falls under the jurisdiction of the competent courts of Nantes, France, to the extent the law permits such a choice of jurisdiction.
